Reading instructions from the schedule
2011-09-02 09:00: For time reasons, the students are not expected to prepare by any reading for the lecture on Friday. Yet, those who wish may already now read J. Ebbesson, "European Legal Strategies to Global Environmental Cooperation", in 2 Swedish Studies in European Law (2007). The students should also consider - and be prepared to discuss - different transboundary dimensions of environmental law, why international, supranational and transnational norms have developed in the first place, and whether they are adequate. They should also ponder on whether and how international and supranational norms may affect the legal situations for private actors.

Questions:
Clarify the differences between (i) the principle on the prevention of pollution and environmental harm, and (ii) the principle of “global responsibility”.
BBR refer to the procedural as well as substantive aspects of the principle on the prevention of harm. Clarify the distinction and its relevance when making states responsible.
Explain the shortcomings, if any, of the principle on the prevention of harm to effectively deal with some situations of pollution or environmental harm.
