Examination

Remember when studying for the exam that the purpose of the course was to give you an
understanding in depth of the fundamentals of competition law. The exam will therefore concentrate on the three main tools of competition law: Article 101, Article 102 and the Merger Regulation. The material from the seminars will be directly relevant as will the material from the lectures on those topics. The other topics were taught more at an introductory level to round out your understanding of the subject. You would need further study of some of these to achieve the level of understanding we hope for in respect of Articles 101, 102 and the Merger Regulation.
The exam will consist primarily of problem type questions. You can expect to answer three questions. Questions One and Two will be compulsory. The third question will offer two choices. In the answers we will be looking to see how you make use of the primary sources: the court judgments, the Commission decisions, the legislation and any relevant guidelines.

You will have four hours to write the exam.

The exam will be an open book exam. This means that you are allowed to bring the books relevant to the course (that is the books listed on the literature list for the course) as well as handouts, slides and notes taken during the lectures. Most importantly you may bring in all public documents such as legislation and Commission decisions,' notices, regulations etc. as well as court judgments. You can also use a language dictionary if needed and a simple calculator. The test will be open book but the exam questions will require considerable time for diagnosis so do not expect much time for looking afresh at issues simple because you have the sources with you. Ideally, they are there to allow you to check on detail if necessary.

You are not allowed to bring old exams, answers to old exams, the seminar assignment or communications devices.

The results of the exam will be published in Fastreg within 3 weeks after the exam.
