Verksamhetsområde: My research analyses some of the new elements introduced by Directive 2004/18/EC, using the hypothesis that the new regulation provides contracting authorities with enough tools as to manage the main risks relevant to the procurement activity. The research is structures as it follows:
1. Introduction dealing with the scope of application and new procurement criteria, in particular the definition of contracting authority, the so-called “in house” exception and social and environmental criteria in public procurement.
2. Modernisation
a. Dematerialisation: the introduction of e-commerce business models in public procurement (electronic means of communication, electronic reverse auctions, electronic catalogues, electronic market places and e-security).
b. Rationalisation: this use of demand aggregation in public procurement (central purchasing, inventory sharing and framework agreements vs. electronic dynamic systems).
3. Flexibility
a. Procedure overview, comparing the negotiated procedure and the competitive dialogue and how the introduction of latter should eliminate the use of the former to award complex contracts.
b. Competitive dialogue as a vehicle for the award of complex contracts (PPP and IT projects).
c. Competitive dialogue as a vehicle for the introduction of innovation in public procurement.
4. Comparison: implementation of the Directive in Spain and Sweden, making reference to the future public procurement act in Spain and to any future amendments in the Swedish LOU.
Methodologically the research aspires to be teleological, using risk management, functional equivalence and qualitative research techniques such as elite interviews to achieve its goals.
