A general point of departure is that competition within the Community could become more effective if the supervision of it were to be more decentralized. The analysis includes not only an examination of the relationship between Community competition law and national competition law in the narrow sense, i.e. which legal order takes precedence in case of conflict, but also analyzes the division of competencies between the Commission and national courts and authorities concerning the application of Community competition law and, finally, the obligations of the member states when regulating the competitive conditions on a national level.
The conclusions are that the actual room for, and need of, a more decentralized application of competition law has increased during the last couple of years, without, however, there being enough formal room for a more elaborate division of competencies. In relation to state intervention only would there seem to be a more elaborate division of competencies. Concerning the other areas, formal or practical obstacles stand in the way of enhanced decentralization. |
