The study is divided into two parts. In the first part, a discussion of the evolution of the Convention, its legal status within the EC legal order and in the wider context of public international law is undertaken. Further, the institutions set up under Lomé are investigated. This part discusses also human rights, democracy and the rule of law, as well as the European Development Fund (EDF) contracts. In addition, the study looks at the compatibility of Lomé with the legal framework of the General Agreement on Tariffs and Trade (GATT) and the World Trade Organization (WTO). The study further investigates whether Lomé may be an answer to the New International Economic Order (NIEO), and considers its uniqueness within North-South relations.
The second part of the study focuses on the instruments of ACP-EC cooperation. These are: trade, industrial cooperation, stabilisation of export earnings from agricultural products (STABEX) and the special facility for minerals (SYSMIN), the Banana, Rum, Sugar and Beef and Veal Protocols, as well as financial and technical cooperation. An investigation of future ACP-EC cooperation rounds off part two of this thesis.
The study endeavors to give a comprehensive view of the Lomé IV Convention covering all its major areas. Further, the study tries to combine in each chapter legal analysis with the examination of practice, and where necessary, compares the provisions of the Convention with international practice. |
